Health Care partner Michael Callahan was interviewed by ED Legal Letter for an article on protecting hospital emergency room peer review materials from discovery in a medical malpractice law suit. Michael noted the importance of understanding what administrative steps are needed to comply with state laws in order to maximize available statutory protections. Staying current with state peer review statutes is crucial, as the courts tend to take a technical approach to them. He added, "If you don't come into full compliance and it's a bad case, the court will find a way to argue that the protections don't apply." Michael also examined the role that a Patient Safety Organization (PSO) could play in peer review reports and discussions.
